FC: The Death Penalty
1: Why do we have the Death Penalty? Some believe that it is "cruel" or "unusual" punishment. Our United States supreme court does not. They say that it | is not cruel or unusual, it is a form of justice that our court system uses.
2: The matter in which you execute someone can be considered inhuman and barbarous. | There is a lack of the words "cruel" or "unusual" in the comstitution the death penalty in societys opinion is okay.
3: The imposition and exicution of the death penalty are obviously cruel in the dictionary sense. But the penalty has not been considered cruel and unusual [punishment in the constitutional sense. Because it was thought justified by the social ends it was deemed to serve a purpose.
4: The penalty of death differs from all other capital punishment, not in degree but in kind. It is uniqe inits total irrevocability. It is unique in its rejection of rehabilitation of the convicted as a basic purpose of criminal justice. And it is unique, finally. In its absolute renunciation of all that is embodied in our concept of humanity.
